Family Based Green Card

United States Citizens and Permanent Residents of the United States can file family based immigrant petition for their family members. Broadly, there are two categories under family based immigrant petitions, 1) Immediate relative and 2) Family preference. Under the Immediate relative of the United States Citizens, spouse, unmarried children under the age of 21 and parents are qualified to be beneficiary. Under the Family preference, other than immediate relatives or distant relatives of the United States Citizen or Permanent Resident may qualified to be beneficiary. Time to get the green card or become permanent Resident by immediate relative of the United States Citizen is much less than by the distant relatives of the U.S. Citizen or Permanent resident. Form I-130, petition for an alien relative is the first step to file family based green card petition and once this petition is granted, filing of form I-485, application to register permanent Residence. Under specific circumstances, concurrent filing of form I-130 and I-485 is also permitted.

General Requirements:

  • United States Citizen or Permanent Resident of the United Sates will file form I-130 with the USCIS to prove the relationship between the petitioner and the beneficiary.
  • If USCIS approved the petition, the case will be forward to the National Visa Center for consular processing with the copy to the petitioner.
  • Once the visa has become available, the beneficiary will file form I-485, immigrant petition with the USCIS to adjust status in the United States or process through NVC for consular processing based on the circumstances and specific conditions.
